安省不允许房东任意驱赶租客

Under the Residential Tenancies Act (the RTA), there are things that Landlords are not allowed to do:

Landlords cannot shut off or deliberately interfere with the supply of a vital service (heat, electricity, fuel, gas, or hot or cold water), care service or food that your landlord must provide under your tenancy agreement. Temporary Shut-down of services are allowed if this is necessary to make repairs.



如果房客不支付租金但没有搬走,房东不得扣押房客的个人财产。只有在有“房东和房客委员会”的逐客令,并且有警察前来出租单位执行逐客令,房东才能把房客锁在门外。

Taking possession of tenant’s personal property is not allowed if the tenants do not pay rent and they are still living in the rental unit. Landlords cannot lock a tenant out of the rental unit unless they have an eviction order from the Landlord and Tenant Board (LTB) and the Sheriff comes to your rental unit to enforce it.

房东不能要求房客通过延期兑现支票或银行自动走账来支付租金。房东可以建议房客以这些方式支付租金。如果房客不愿意以这些方式支付租金,房东不能因此拒绝出租或驱逐房客。

A landlord cannot Insist that the tenant pay rent by post-dated cheque or automatic debit. These ways of paying rent can be suggested by the landlord but the tenant cannot be refused a rental unit or evicted for refusing to give them.

There are two sides to every tenancy agreement. We must therefore look at the rights and responsibility for tenants as well as under:

Tenants have the right to continue to live in the rental unit until they give their landlord proper notice of their intentions to move out, or both parties agree that the tenants can move, or the landlord gives notice to end the tenancy for a reason allowed by the RTA.

“住宅租赁法”规定,如果房东发出通知而终止租约,房客可以拒绝搬走。为此,房东必须向“房东和房客委员会”申请逐客令。房客有权利向委员会解释他们为什么不搬走的原因。

The RTA stipulates that If a landlord gives notice to end the tenancy, the tenants do not have to move out. The landlord must apply to the LTB to get an order to evict the tenants and they have the right to go to a hearing and explain why their tenancy should not end.



房客有隐私权 - 房东只能按“住宅租赁法”允许的原因进入租赁单位。在大多数情况下,进入出租单位之前,房东必须给房客24小时的书面通知。例外是,在紧急情况下或房客同意,房东才可以进入。

Tenants have the right to privacy - The landlord can only enter the rental unit for the reasons allowed by the RTA. In most cases, before entering the unit, landlords must give the tenants 24 hours written notice. There are some exceptions, however, such as in the case of an emergency or if the tenants agree to allow the landlord to enter.

房客必须按时支付租金,保持出租单位整洁。出租单位的整洁和磨损的标准应符合大众认可的要求。不管有意无意,房客或房客的客人如果损坏了出租单位,房客要负责维修。

Tenants are responsible for paying their rent on time. They are also responsible for keeping their unit clean, up to the standard that most people would consider ordinary or normal cleanliness and normal wear and tear. Tenants shall repair any damage to the rental property caused by them or their guests - whether on purpose or by not being careful enough.

没有房东的许可,房客不得更换进入租赁单元的门锁。

Tenants are not allowed to change the locking system on a door that gives entry to the rental unit unless they get permission from the landlord.



由于出租单位供不应求,多伦多和温哥华等城市的租金不断涨价,一些房东正试图驱逐房客,以更高的租金向新房客出租。2018年,多伦多对现有房客的租金涨幅限制为1.8%。大多情况下,房东不用“房东和房客委员会”的许可而增加租金。

With the latest increases in rent within cities like Toronto and Vancouver due to demands and scarcity in rental properties, some landlords  are trying to evict their tenants so they can rent out the property again to new tenants at a higher rate. In 2018, the allowable increase for rental units to existing tenants is only 1.8% in Toronto. In most situation, landlord can increase the rent without applying to the LTB.

In Ontario, the RTA was amended on September 1, 2017 under Bill 124 to ensure that landlords cannot abuse the RTA provisions on Eviction for Personal Use, Demolition, Repairs and Conversion. As a result of Bill 124, it becomes very difficult for landlords to re-possess rental units for use by themselves or their family members. There are now more restrictions and penalties for abuses of such actions. Bill 124 also made many other changes to the RTA 2006.
