Opinion: Loss of IP assets to China in data-driven economy hurts average Canadians

Driven by an ambition to take the lead in global science and technology, China has set its sights on the Canadian high-tech industry, exploiting its academic talents and breakthrough reward to advance its economic and geopolitical interests. Canada seemed naïve about China's ambitions, inadvertently losing our trade secrets, intellectual properties, and sensitive data to China's infiltration efforts and state-controlled firms. The Canadian government's incapacity in protecting IP and its derived values in this highly competitive high-tech world has stark implications for middle-class Canadians.
Huawei has been a dominant player in the global 5G race and the top patent filer over the past five years. However, the Canadian tech industry's blood, sweat, and tears have paved the road to Huawei's achievements and success. According to the Globe report in 2018, Canada has provided vast resources to Huawei-funded research, including government grants and the talent and skills of hundreds of professors and graduate students from leading universities. The extent of Huawei's inroads into the Canadian research industry is alarming as it has reaped all the exclusive rights to Canadian taxpayer-funded research in 40 cases and claimed ownership of nearly 80 unique patents invented by Canadian universities in recent years. Moreover, Ottawa has also lent a hand to China's tech giant in harvesting the Canadian research fruits –granting export permits to transfer the Canadian research back to China.
More ironically, the federal government has been reluctant to take action against Huawei's extensive dealings in Canada's R&D field, even after it decided to ban Huawei from Canada's 5G networks over national security concerns. Without the government's instructions to sever the ties with Huawei, Canadian Universities – including McGill, UBC, and U of T have continued to embrace the collaborations with the Chinese tech giant that puts their research outcomes at risk.
Ottawa's loss of guard in protecting Canadian IP, amid Canada's enthusiastic pursuit of deeper ties with China before the arrest of Huawei executive Meng Wanzhou, was more evidenced by what happened at the Winnipeg lab -- Ottawa's top-security infectious-disease laboratory. The RCMP investigation has uncovered the lack of the Standard Material Transfer Agreement specifying Canada's intellectual-property rights while the lab was transferring the highly infectious viruses to the Wuhan Virology Institute. The scandal, with the Chinese scientist Qiu Xiangguo being the central figure, has sparked an intense political battle between the federal parties, which has grown into an international controversy.
IP assets and data rights have played an increasingly important role in today's data-driven economy as global enterprises compete to gain a commercial edge from high-margin IP technology. Falling behind in the worldwide IP race has dealt a harsh economic blow to the Canadian middle class, causing average Canadians' purchasing power to lose ground. The shrinking share of IP-related income and wealth has plunged the average salary of Canadians to US$43,242 in 2020 from the peak of US$52,635 in 2013, while China's tech sector values and per capita GDP were soaring rapidly. The Canadian policymakers should realize this dark reality, taking immediate actions to reverse the dangerous trend of transferring taxpayer-funded research to foreign countries.
