柯文彬、刘燕、赵长春,请告诉公众你们究竟为柯文彬的官司募捐了多少钱?

2023年3月,安省Don Valley North选区的保守党省议员(MPP)柯文彬因媒体报道他涉及中国政府干预加拿大的政治选举的活动而离开了保守党,成为独立省议员。

In March 2023, Mr. Vincent Ke, the Progressive Conservative MPP for Don Valley North in Ontario, left the party to sit as an independent after media reports alleged his involvement in activities related to Chinese government interference in Canadian elections.

加拿大的Global News报道说,情报来源称柯文彬充当了中国驻多伦多总领事馆的转钱的中介,收取了大约5万加元,用于干涉加拿大选举。

According to Global News, intelligence sources claimed that Mr. Ke facilitated money transfers for the Chinese Consulate-General in Toronto, receiving approximately $50,000 in order to help those who were seeking public offices, pro-Beijing candidates.

柯文彬否认这些指控,称报道虚假,是对他的诽谤。他辞职时表示,他不希望分散政府工作的注意力,选择出退保守党,以专注于为自己洗清指控。

Mr. Ke denied the allegations, calling the reports false and defamatory. When he resigned, he stated that he did not want to distract from the government’s work and chose to leave the PC Ontario to focus on clearing his name.

随后,柯文彬把Global News告上法庭。

Subsequently, Mr. Ke filed a lawsuit against Global News.

Global News认为柯文彬的指控没有根据,并用安省的“反公众参与策略法” (Anti-Slapp)要求法院驳回原告的诉讼。

Global News argued that Mr. Ke’s lawsuit had no merit and sought to have it dismissed under Ontario’s Anti-SLAPP Act (Strategic Lawsuit Against Public Participation).

2024年8月,安省法院驳回Global News的动议,柯文彬可以继续他的民事诉讼。

In August 2024, an Ontario court dismissed Global News’ motion, allowing Mr. Ke to proceed with his lawsuit.

2024年10月30日,多伦多的中文媒体”星星生活“刊登了一篇文章:“加拿大亚裔司法公正委员会将举办拍卖会,为安省议员柯文彬维权筹资”。

On October 30, 2024, Superlife.ca, an online publication in Chinese-language in Toronto, published an article titled: "The Asian Legal Access Committee to Hold Auction to Fundraise for Ontario MPP Mr. Vincent Ke’s Legal Battle."

此文既没有注明是报道,还是公告。

The article did not specify whether it was a news report or a public announcement.

文章说:“柯文彬不当软柿子,状告主流记者诽谤,取得第一步胜利。”

It stated: “Mr. Ke is not a soft target. He has sued mainstream journalists for defamation and achieved his first victory.”

文章继续说:“虽然安省高级法院驳回被告的动议,但是这场官司远远没有完结,初步判决只是肯定了原告向无良媒体及无良媒体人维权起诉的正义性。官司必须继续打下去,(以)保证每一个受到无端污蔑的亚裔都有能力拿起法律的武器,(只有这样)媒体下一次向我们泼脏水的时候才会有所忌惮!”

“Although the Ontario Superior Court dismissed the defendant’s motion, this lawsuit is far from over. The preliminary ruling merely affirms the legitimacy of the plaintiff’s legal action against unscrupulous media and the journalist. The lawsuit must continue to ensure that every Asian who is baselessly slandered has the ability to take legal action. Only in this way will the media hesitate before smearing us again!”, the article continued.

文章说:“亚裔司法公正委员会正在准备一场拍卖募捐活动,本次维权主要目的是支持柯文彬先生把告Global News的官司进行到底。如果这次官司获得赔偿,柯文彬先生将把本委员会捐赠金额全数返还,作为下一个受害者的法律基金。”

The article added: “The Asian Legal Access Committee is preparing an auction fundraising event. The primary goal of this initiative is to support Mr. Ke in his lawsuit against Global News to the very end. If he wins compensation from this lawsuit, he has pledged to return all donated funds to the committee, creating a legal fund for the next victim.”

该公众募捐活动定于2024年12月24日在新动力演播厅进行。

The public fundraising event was scheduled for December 24, 2024, at Xinflix Media, a Chinese media in Markham, Ontario.

文章没有说明柯文彬已经花了多少律师费,他的经济情况如何。也没有说明如果无法去现场捐款,公众如何向指定的银行账户捐款。

The article did not disclose how much Mr. Ke had already spent on legal fees, his financial situation, or how members of the public could donate if they were unable to attend in person.

大中网(096.ca, 前大中报)的搜索发现,捐款的组织者,“亚裔司法公正委员会 (Asian Legal access Committee)” 没有任何政府注册记录。

A search by Chinese News (096.ca), an online publication (formerly a Newspaper) found that the fundraising organization, the Asian Legal Access Committee, had no government registration records.

大中网随后给文章的联系人赵长春、刘燕打电话,发电邮。

Chinese News attempted to contact the names in the article, Mr. Changchun Zhao and Ms. Christin Liu, a close associate of Mr. Ke, via phone and email.

给刘燕的电话和留言石沉大海。

Attempts to reach Ms. Liu by phone and voicemail went unanswered.

赵长春在电话上告诉大中网,他不是亚裔司法公正委员会的发言人,他自告奋勇做此事纯粹是担心如果让主流媒体诽谤华人的事得逞,华人在加拿大的日子不好过。

Mr. Zhao told Chinese News over the phone that he was not the spokesperson for the Asian Legal Access Committee. He claimed he volunteered for the initiative because he feared that, if mainstream media succeeded in defaming Chinese Canadians, their lives in Canada would become more difficult.

赵长春拒绝向大中网证实亚裔司法公正委员会是否在政府注册,该委员会究竟都有哪些成员。关于谁是该协会的发言人,他让大中网去问刘燕。

However, Mr. Zhao refused to confirm whether the Asian Legal Access Committee was officially registered with the government or to disclose who are the board members of the committee. When asked who the committee’s spokesperson was, he directed Chinese News to Ms. Liu.

Online searches show that Mr. Zhao is the current president of the Confederation of Chinese Alumni Associations (CCAA), which claims to have over 20,000 members from 103 Chinese universities in Canada.

11月24日捐款结束后,多伦多在线在12月16日刊登了铁木尔(赵长春)写的,加拿大亚裔司法公正协会的“加拿大亚裔司法公正委员会筹资维权募捐拍卖会成功举办”新闻稿。

After the fundraising event on November 24, www.torcn.com,  a Chinese online publication in Toronto, published a news release on December 16, written by Mr. Zhao on behalf of the Asian Legal Access Committee, titled “The Asian Legal Access Committee Successfully Holds Fundraising Auction for Legal Battle”.

新闻稿说:近年来,个别无良媒体和记者望风捕影无端攻击大陆背景议员,严重危害了华裔平权参政(的)地位!在被揭报道不实后拒绝道歉并要求法院撤销对其诉讼。(结果动议)被法官驳回!目前维权形势大好!虽然诉讼取得了决定性的胜利,但是为了彻底打赢官司还需要较高费用,现通过拍卖筹款。如果这次官司获得赔偿,柯文彬先生将把本委员会捐赠金额全数返还,作为下一个受害者的法律基金。

The release stated: “In recent years, certain unscrupulous media and journalists have engaged in baseless attacks against politicians with mainland Chinese backgrounds, seriously undermining the political rights and participation of Chinese Canadians! When exposed for inaccurate reporting, they refused to apologize and instead sought to have the lawsuit against them dismissed. Their motion was rejected by a judge! The legal fight is in an excellent position! Although we have achieved a decisive victory in this lawsuit, significant funds are still needed to win the case completely. We are now raising funds through an auction. If this lawsuit results in compensation, Vincent Ke has pledged to return all donated funds to the committee to support the next victim’s legal battle.”

新闻稿只字没提此次活动究竟筹了多少款,扣除筹款成本后,究竟多少钱交给了柯文彬。

However, the release did not disclose how much money was raised, how much was left after deducting fundraising costs, or how much was given to Mr. Ke.

捐款结束后,大中网就以上问题给柯文彬、赵长春、刘燕的电话、电邮和短信,到发文为止,对方均未答复。

After the donation campaign ended, Chinese News attempted to contact Mr. Ke, Mr. Zhao and Ms. Liu Yan via phone, email, and text messages regarding the above questions. As of publication, none had responded to Chinese News.
